Entry into this campaign is deemed acceptance of these Terms and Conditions.

Eligibility

• This campaign is open only to those who follow the entry rules as stipulated in the promotion al poster and who are 18 years old as of the date of entry.

• The campaign is only open to legal residents New Zealand.

• Employees of Mangawhai Meat Shop its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the campaign. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step child (whether natural or by adoption), parent, step-parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.

• The campaign is subject to all applicable New Zealand laws and regulations. Void where prohibited.

Agreement to Rules

• By participating, the contestant (“You”) agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements.

• In addition, you agree to accept the decisions of Mangawhai Meat Shop as final and binding as it relates to the content of this campaign.

Campaign Period

• Entries will be accepted in store starting and ending as communicated via the corresponding campaign information advertised via the corresponding campaign information on this website or instore.

• To be eligible to win, all online entries must be received within the corresponding dates.

How to Enter

• The campaign must be entered by following the entry rules as stipulated on the in store advertising or promotion page on the website. The entry must fulfill all campaign requirements, as specified, to be eligible to win a prize.

• Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Mangawhai Meat Shop.

• If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Mangawhai Meat Shop. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

• Mangawhai Meat Shop reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of Mangawhai Meat Shop. In the event that the winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. Failure by Mangawhai Meat Shop to enforce any of its rights at any stage does not constitute a waiver of those rights.

• Incomplete or incomprehensible entries will be deemed invalid.

• At any time where personal details such as name or email address are required at the time of entry, Mangawhai Meat Shop’s Privacy Policy will apply. We will never share your details.

Prizes

• The Winner(s) of the campaign (the “Winner”) will receive the prize specified on via the corresponding campaign information on this website or the in store poster.

• Prize value will be stipulated at time campaign is communicated. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Mangawhai Meat Shop.

• No cash or other prize substitution shall be permitted except at Mangawhai Meat Shop’ discretion. The prize is nontransferable. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted.

• Prizes (or any unused portion of a Prize) are not transferable or exchangeable. Once a Prize has left Mangawhai Meat Shop’s control and/or is in transit, Mangawhai Meat Shop will not be liable for any loss or damage to that Prize.

• Acceptance of prize constitutes permission for Mangawhai Meat Shop to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Winner Selection and Notification

• Winner(s) will be selected by Mangawhai Meat Shop. Winner(s) will be notified by Email.

• Mangawhai Meat Shop will not be liable for a Prize Winner who cannot be contacted. Mangawhai Meat Shop shall have no liability for winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information.

• If a winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize will be forfeited.

• Receipt by winner of the prize offered in this campaign is conditioned upon compliance with any and all New Zealand and local laws and regulations.

Rights Granted by You

• By providing your information, you authorise Mangawhai Meat Shop to include you in our mailing list. We'll always treat your details with the utmost care and will never sell them to other companies for marketing purposes. All emails include an unsubscribe link and you may opt-out at any time.

• By entering this content (e.g., photo, video, text, etc.), you understand and agree that Mangawhai Meat Shop, anyone acting on behalf of Mangawhai Meat Shop, and Mangawhai Meat Shop’ licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, statements about the campaign, for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent.

• If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of Mangawhai Meat Shop. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Mangawhai Meat Shop from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Mangawhai Meat Shop may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

Terms and Conditions

• Mangawhai Meat Shop reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the campaign should virus, bug, non-authorised human intervention, fraud, or other cause beyond Mangawhai Meat Shop’ control corrupt or affect the administration, security, fairness, or proper conduct of the campaign.

• Mangawhai Meat Shop reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the campaign or website or violates these Terms and Conditions.

• Mangawhai Meat Shop has the right, in its sole discretion, to maintain the integrity of the campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by campaign rules; or the use of bots, macros, scripts, or other technical means for entering.

• Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the campaign may be a violation of criminal and civil laws. Should such attempt be made, Mangawhai Meat Shop reserves the right to seek damages to the fullest extent permitted by law.

• Mangawhai Meat Shop reserves the right to amend or update these terms & conditions.

Limitation of Liability

• By entering, you agree to release and hold harmless Mangawhai Meat Shop and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorised human intervention in any part of the entry process or the campaign; (v) electronic or human error in the administration of the campaign or the processing of entries.

• No responsibility is accepted for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over mobile telephone communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.

• Mangawhai Meat Shop reserves the right, in its absolute discretion, at any time before the awarding of the Prize to cancel the campaign or to vary or cancel the award of the Prize. In the event that the Mangawhai Meat Shop cancels the campaign or varies or withdraws the Prizes it shall not:

1. be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and

2. be required to conduct the campaign at any other time.

Disputes

• This campaign is governed by the laws of New Zealand, without respect to conflict of law doctrines. As a condition of participating in this campaign, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Whangarei, New Zealand having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this campaign). Participant further waives all rights to have damages multiplied or increased.
